Unless otherwise stated in a quote or other agreement, the following are the standard terms, conditions of service, and warranty for all services at Legacy Finishing, Inc.
PRICING:
Prices are subject to
change based on changes in material and utility costs.
SET – UP:
When
the total invoice is less than $500.00 per color, per release there
will be an additional set-up charge.
POWDER:
Pricing
assumes standard stock pricing and availability of powder. Custom and non-stock materials may require a
different price structure. Customer must
issue a blanket Purchase Order for all powder used. Legacy Finishing will order and inventory as
needed to fill open orders. All powder
ordered and not consumed must be purchased by customer and/or pay any
restocking fees for returned powder.
PAPER WORK:
The customer is responsible for supplying
incoming paperwork with each order that identifies at a minimum:
Part Number and/or Description
Quantity
Specific Color / Powder Number
Date Requested
PO or Reference number
Masking, packing or other special
instructions.
CUSTOMER REQUIREMENTS:
Legacy Finishing, Inc. will assume the
customer has no special requirements other than as listed in the quote or other agreement provided at the time of service. Customer must provide any written
specifications to include requirements of adhesion, salt spray, chemical resistance or
other properties the coating is required to meet at the time of a request for quote and/or prior to the processing of any order. The parts included with quote will be
processed as listed in the quotation unless the customer provides additional
detail. Legacy Finishing, Inc. reserves the
right to re-quote parts based on changes in specifications or other
requirements.
FREIGHT:
Customer is responsible for inbound and outbound
freight. Legacy Finishing, Inc. has multiple trucks and methods to provide pick-up and delivery services. These services can be negotiated in a quotation or at the time of service request. As with all other costs, prices are subject to changes in costs such as fuel.
PACKAGING:
All packaging includes stretch wrap and banding as
needed and returned on/in the same skids/containers as received. Packaging needs must be specified by the customer. Parts can be packed with
foam, bags or other protective materials but may require an additional charge.
TOOLING:
No special tooling is anticipated for the processing of the orders.
PROCESS:
Legacy Finishing, Inc.’s process will include standard washing
and powder coating procedures.
MASKING:
Parts will be processed with no masking requirements, unless otherwise noted in a quote or other agreement.
FOREIGN MATERIAL:
Legacy Finishing is not responsible for parts received
with scale, rust or other foreign material not removed during standard cleaning
operations. Removal may require an
additional charge. This includes laser
scale, tape residue, and permanent marker. Legacy finishing is also not responsible for problems with plating, galvanizing, and other surface treatments on the parts prior to processing.
ADDITIONAL OPERATIONS:
Legacy Finishing reserves the right to amend prices on
additional operations such as sorting or sub-assembly not included in the quote or other agreement.
REJECTIONS, RETURNS, DEBITS, CREDITS,
ETC:
Any discrepancies in part quality, counts or any other
issues that require a corrective action, debit/credit or other response, must
be made in writing to Legacy Finishing. within 24 hours of receipt of parts. All requests for a debit/credit will be
reviewed by Legacy Finishing and must be approved by a member of the senior
management of Legacy Finishing
TURNAROUND:
Turnaround may vary depending on seasonal or other work load demands as well as material availability. Parts are typically processed on a first in, first, out (FIFO) basis. Legacy also offers “On-demand” Scheduling where turn-around can be negotiated based on
customer needs. To receive the best
service, call in advanced to schedule time.
TERMS:
Net 30 (Based on credit approval)
EXPIRY:
Prices quoted hereon are firm for 30 days
from date on the quotation.
Conditions of Service and
Warranty:
Services will be performed and materials will be processed only as
described above. All materials will be
heated to temperatures above 400°F. Lead fills, body filler, rubber
gaskets, bearings and other items sensitive to heat cannot be processed. Detection and disclosure of such sensitive
items and request for special processing and desired finish properties shall be
the sole responsibility of the Customer.
Faraday areas such as deep
cavities and tight gaps in addition to rough or improper welds, seams, and
pitted areas may not receive uniform coverage.
Customer shall indicate areas that need to be masked such as bearing
races, threaded holes, etc. Special
cleaning and preparation, parts removal, masking, and engineering for a
particular purpose or use will be performed upon written request for an
additional charge.
Legacy Finishing Inc (LFI) is also
not responsible for problems relating to rusting or non-uniform or irregularity
coating caused or associated, in whole or part with, surface roughness,
welding, pits, craters, out-gassing, pinholes, or return of rust after blasting
and/or powder coating; mill scale, laser scale, plating, die lubes, release
agents, weld flux, galvanized treatments, rust or other foreign material not
removed during standard cleaning operations; hidden or unknown materials,
treatments or coatings not disclosed by the Customer at the time of request for
services; or the failure to inspect and report in writing to LFI all defects in
quality or quantity on or before 24 hours from the earlier of receipt or pickup
of the materials for LFI. Customer
acknowledges that the sole remedy for any defects for which LFI is responsible
is limited to reprocessing by LFI of the materials in the same manner as
originally agreed upon. LFI reserves the right to sell, scrap, or otherwise
dispose of any unclaimed items (whether or not there remains a balance due for
services) left at LFI over 30 days from the date services are performed, such
items shall be deemed abandon by the Customer.
The pricing is an estimated cost made during the initial
evaluation. If the pricing will exceed
more than 10% of the estimated value, LFI will notify the customer. If the customer refuses the additional costs,
the customer will still be responsible for costs incurred up to that point.
EXCEPT
AS EXPRESSLY SET FORTH ABOVE, THE SERVICES PROVIDED BY LFI ARE WITHOUT
WARRANTY AND ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING, BUT NOT LIMITED TO,
THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE
ARE DISCLAIMED TO THE EXTENT PERMITTED BY LAW. IN NO EVENT SHALL LFI BE LIABLE
FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR
CONSEQUENTIAL DAMAGES (INCLUDING, BUT NOT LIMITED TO, PROCUREMENT OF SUBSTITUTE
GOODS OR SERVICES; LOSS OF USE, DATA, COSTS OF INSTALLATION/REMOVAL,
TRANSPORTATION, SHIPPING OR PROFITS, OR BUSINESS INTERRUPTION; HOWEVER CAUSED
AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT
(INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OR
INABILITY TO USE LFI SERVICES OR THE MATERIALS SERVICED, EVEN IF ADVISED OF THE
POSSIBILITY OF SUCH DAMAGE.
